Probate procedure in Germany – special questions 1

Which institution is competent for the probate procedure?

Competence for the probate procedure lies solely with the “probate court”, that is the local basic court. 

The question which court is competent is answered by the usual residence of the testator.

It is not relevant where the testator was officially registered, but rather where s/he really lived. If s/he was registered in Munich, but actually lived in Hamburg, then the probate court in Hamburg is competent for the procedure.
