German inheritance law: Costs of depositing wills in Germany

In another article on this website we already warned against depositing wills in a bank safe. The reason is that once the last will is in a bank safe, the heirs might not get access to the safe without a certificate of inheritance. And without the will, the heirs might not get the correct certificate of inheritance fully in correspondence with the will of the testator. This little „vicious circle“ can easily be avoid by depositing wills with the competent court. 

When depositing your will with a court, we make use of a service of a public body which of course costs money – as almost whenever we use public services.

But the amount we have to pay for this special service has been considerably reduced since the last reform of the relevant law.

The uniform costs for the deposition of wills amounts now to 75,- €. This is independent of the value of the estate and the length of the depositing.

If a testator is sure about how s/he wants to govern the estate after death and wants to get rid of any worries about whether the will gets into competent hands without any danger of manipulation, the depositing of the will with the court is the advisable way.
